Brewing news USA: Clerk being cited by police for beer sales to a minor

A recent citywide sting resulted in a clerk being cited by police for beer sales to a minor at a convenience store where at least two other citations were issued since February 2004.

An illegal beer sale allegation against Candi D. Toepfer, 21, was presented on January 3rd to the Kingfisher County district attorney's office, Kingfisher Police Chief Dennis Baker stated according to the report of The Oklahoman.

The law of the state mandates that persons must be 21 years old to possess, buy or consume beer and other alcoholic beverages. Sale of alcohol of less than 3.2 percent to a minor is a misdemeanor punishable by up to six months in the county jail and up to a $500 fine.

At the time, Toepfer was employed at Domino Fuel Stop, 100 W Mitchell Blvd. Baker said all Kingfisher businesses selling 3.2 beer were targeted during the sting. No other citations were issued during the sting.

Another clerk at the same store also sold beer to a minor in October 2005 and February 2004.

State law does not provide for punishment of businesses that sell low-point beer to minors, said H.T. Scott, assistant director at the Alcoholic Beverage Laws Enforcement Commission. "They can sell low-point beer to minors three times a day," and not be penalized, Scott said.

Baker said a 19-year-old male volunteer was used in each attempted low-point beer purchase Saturday evening. He was stripped of all identification and given patrol money to purchase a six-pack of beer. If asked for identification, he was advised to tell the clerk he didn't have it with him, Baker said.

As part of the alcohol crackdown during the holiday weekend, officers arrested as well two persons suspected of driving under the alcohol influence.
